WHAT HIGH STREET CLAIMS WILL DO:
We will progress your case(s) by assessing each of your application(s) and endeavour to inform you of the outcome within 14 days of receipt of the completed claim pack(s). We will endeavour at all times to act in your best interests in progressing your claim(s). We will assist you in completing all or part of the application(s), and/or any subsequent forms which you may be experiencing trouble with. We will inform you of all offers that we receive from the bank(s) or lender(s). We will consult with the bank(s)/lender(s) and locate any other accounts that may hold PPI/ PBA to enable us to progress any claim(s) on your behalf. We will keep you updated via SMS, email, post and telephone and may contact you from time to time about our other products and services. In signing these terms and conditions you agree to instruct HSC to attempt to bring a claim for all products with the bank/lender. HSC will be entitled to a contingency fee (as set out below) for all products with the bank/lender including cases which you have not directly signed a separate letter and/ or terms and conditions.
HSC have the right to cancel this agreement at any time and no fee will be payable by you if we think there are no grounds for a complaint or that your claim is unlikely to succeed. HSC shall have the right to terminate the contract by giving written notice to you at any time to immediately terminate the contract if there is any material breach by you of any term within the contract. There is a 14 day cooling off period in which you may cancel the agreement in writing without charge. In the event that you terminate the contract after 14 days HSC are entitled to charge a reasonable cancellation fee that will reflect the work undertaken by HSC in pursuit of the claim. If a reasonable offer is made and you then cancel, HSC will be entitled to claim our full fee of 30% inclusive of VAT.
Cancellation of any claims MUST be done in writing and notice will only be effective if and when received at the following address: - High Street Claims, Cancellations Department 2nd Floor Cuthbert House Newcastle upon Tyne NE1 2ET.
If it is found that, following termination of the agreement, a successful claim is upheld, money is recovered and that HSC was the effective cause of such settlement, HSC’s original invoice will remain valid. The full invoice will fall due in respect of the original agreement of 30% inclusive of VAT.
LAW & JURISDICTION
The law applicable to this contract shall be English Law and the parties consent to the jurisdiction of the English courts in all matters affecting this contract. Services provided to you may include commencement of legal proceedings to recover compensation, but this is not applicable in every case. HSC makes no representation or warranty to you that compensation will be obtained or is in any way guaranteed. HSC cannot accept any responsibility for the loss of benefits under a Packaged Bank Account and/or PPI policy which is cancelled as part of a successful compensation claim.
FEES & PAYMENT
HSC will endeavour to recover all monies owed. Example: Compensation awarded to you is £500.00 our fee is £180.00 inclusive of VAT being 36% of the total amount recovered. Once you receive compensation payment direct, you MUST pay HSC commission within 14 days of cleared funds being received. Should you receive and accept an offer for the balance of a credit agreement to be written off or for redress/compensation to be offset against arrears, or a goodwill offer (where the case is rejected) the fees will be calculated at 36% including VAT of the write off or amount offset.
Where fees remain unpaid and HSC are forced to either take court action or appoint a debt collection agency to recover outstanding monies, HSC reserve the right to increase the amount owed by an amount equivalent to the cost of that recovery. A court may also award additional cost and/or statutory interest at the rate of 8% above the Bank of England base rate. HSC will seek to recover interest on unpaid fees at the rate of 8% above the Bank of England base rate.
